PLEASE READ THESE TERMS OF USE CAREFULLY. BY USING THE PLATFORM, YOU AGREE TO BE BOUND BY ALL OF THE BELOW TERMS OF USE. THIS IS SUBJECT TO UPDATION AND REVISION FROM TIME TO TIME.

Introduction

The websites (https://www.ayodhyatra.live) and the mobile application on Android and iOS platforms, known as ‘Ayodhyatra’ (together, the “Platform”), are owned and operated by 1Play Global Digital Private Limited (“1Play India”), a private company incorporated in India under the Companies Act, 2013 and having its registered office at E1-407, Kailas Esplanade, LBS Marg, Ghatkopar West, Mumbai-400086, Maharashtra, India. The terms “Company,” “we,” “us,” or “our” refers to 1Play India and includes any of our affiliates, associates, assignees, or successors-in-interest, as determined by us at our sole discretion and without prior notice to you. Your use of the Platform and its services is subject to the terms and conditions set out in these Terms of Use.

Please read these Terms of Use, along with the Privacy Policy available at (https://www.ayodhyatra.live/privacy-policy/) and all other rules and policies made available or published on the Platform, as they govern your use of the Platform and the services provided therein

The words “use” or “using” in this Terms of Use means any time an individual (a “User”, “Users”, “you”, “your” or “yourself”), directly or indirectly, with or without the aid of a machine or device, does or attempts to access, interact with, use, display, view, print or copy from the Platform, transmit, receive or exchange data or communicate with the Platform, or in any way utilizes, benefits, takes advantage of or interacts with any function, service or feature of the Platform, for any purpose whatsoever

By using, visiting or otherwise accessing the Platform and/or its Service, you represent and warrant that you are:

neither a resident, citizen of and nor are you presently accessing the Platform and/or Services from any part of the European Union region;
of legal age and are not in any way barred from entering into a legally binding contract;
neither a person who is deemed ‘incompetent to contract,’ including without limitation un-discharged insolvents nor a minor (i.e., under the age of 18 years) under the Indian Contract Act, 1872 in India as well as under the applicable laws of the country of residence from where this Platform, Services, Terms of Use and/or Privacy Policy are being accessed; and are eligible to enter the binding Terms of Use and Privacy Policy.

As a minor if you wish to avail of any Service and/or otherwise use or transact on the Platform, such Service, use or transaction shall only be made by a person of legal contracting age (legal guardian or parents on behalf of the minor).

We reserve the right to immediately terminate, deny access and take appropriate recourse available in law against you, should we discover or notify you that you are incompetent, ineligible to enter into a binding contract or made any other false, incomplete or inaccurate representations at the time of creating an account herein.

All rights and liabilities of the User with respect to any services or product facilitated by us shall be restricted to the scope of this Terms of Use.

These Terms of Use are an electronic record as per the Information Technology Act, 2000 (as amended/re-enacted and hereinafter cumulatively referred to as the “IT Act”), and Rules thereunder, and are published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, which mandates the publishing of rules and regulations, privacy policy, and terms and conditions for access to or usage of any application or website. This electronic record is generated by a computer system and does not require any physical or digital signature. Additionally, some of the services provided may be subject to additional terms and conditions, which are incorporated into these Terms of Use by reference.

Overview Of Services

1Play India is engaged in the business of digitizing temples and other religious experiences for our users. We provide a range of digital services, including digital puja services, digital astrological consultation services, digital Special Tour and Darshan services, and other related services (“Services”).

Acceptance Of Terms

By downloading, registering, or signing up for the Services, or otherwise accessing, receiving, and using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and the Privacy Policy. These Terms of Use do not cover your rights or responsibilities with respect to third party content, platforms or sites or any links that may direct your browser or your connection to third party sites or pages. This is the entire and exclusive agreement between you and us regarding use of the Platform, its Services and we reserve the right, at any time and from time to time, at our sole discretion, to change the terms of these Terms of Use. We will post notice of such changes to these Terms of Use and Privacy Policies on the Platform. If you object to any such changes, your sole recourse shall be to stop using the Platform and its Services. Your use and continued use of the Platform following notice of any such changes shall indicate your acknowledgement of such changes and agreement to the then applicable Terms of Use and Privacy Policies and you shall be bound by such updated terms and conditions.

If you do not accept or agree to any part of these Terms of Use or the Privacy Policy, your use of the Services will be terminated.

Access And Booking Of Services

Subject to these Terms of Use, we may offer to provide you with selected Services, solely for your own use and not for the use or benefit of any third party. You are advised to check the description of the Services and products and the applicable terms and conditions carefully before making a booking. User(s) agrees to be bound by all the conditions as contained in booking confirmation or as laid out in the confirmed booking voucher. These conditions are also to be read in consonance with these Terms of Use.

If a User intends to make a booking on behalf of another person not being a minor, it shall be the responsibility of the User to inform such person(s) about the terms of these Terms of Use, Privacy Policies, including all rules and restrictions applicable thereto. If a User intends to make a booking on behalf of a minor, the User represents and acknowledges that the User is the parent and/or legal guardian and has the authority to act on behalf of such a minor and agrees to the terms of these Terms of Use, Privacy Policies, including all rules and restrictions applicable thereto. These Services may include, but are not limited to, any services we perform for you. In the event of any discrepancy in the Services provided, you must notify us in writing within 7 (seven) days from the date of the Services provided. If no notice is given within this period, the Services shall be deemed accepted, fulfilled, and satisfactorily completed.

You agree not to circumvent, disable, or interfere with security-related features of the Platform or features that prevent or restrict the use or copying of any restricted information.

Registration And Eligibility

You may, at your sole discretion, sign in to create an account in the Platform and log into the Platform using your email identification and/or the phone number (“Login Details”).

If you elect to register with the Platform, you agree to: a) provide true, accurate, current and complete information as prompted by the registration form; and b) maintain and update such information to keep it true, accurate and current, and complete at all times. Your user name and password are personal to you and you shall not allow any person other than yourself to use the same under any circumstances. We are not liable for any harm caused or related to the theft, disclosure or misappropriation of your user name or password, or your authorization of anyone else to use your user name or password. You agree to immediately notify us if you become aware of or believe there is or may have been any unauthorized use of (or activity using) your user name or password or any other need to deactivate your user name or password due to security concerns.

You shall not:

Provide any false personal information, including false or fraudulent Login Details, or create an account for anyone other than yourself without their explicit permission except in case of the minors, in which case you hereby represent and confirm that you are a parent and/or guardian, and have the authority to act on behalf of such a minor;
Use the Login Details of another person with the intent to impersonate that person.

Your Responsibilities

By using the Platform and/or availing any of the Services, you represent and warrant that:

You have fully read and understood the Terms of Use and Privacy Policy and consent to them.
You will ensure that your use of the Platform and/or Services does not violate any terms of these Terms of Use, applicable law or regulation for the time being in force.
6.3. You have no rights in, or to, the Platform or the technology used or supported by the Platform or any of the Services, other than the right to use them in accordance with these Terms of Use.
You will not use the Platform or the Services in any manner inconsistent with these Terms of Use or Privacy Policy.
You will not resell or make any commercial use of the Services or use the Services in any way that is unlawful, for any unlawful purpose, or in a manner that harms us, the Platform, or any other person or entity, as determined in our sole discretion, or act fraudulently or maliciously.
You will not decipher, decompile, disassemble, reverse engineer, or otherwise attempt to derive any hardware, source code, or underlying ideas or algorithms of any part of the Service (including without limitation any application or widget), except to the limited extent applicable laws specifically prohibit such restriction.
You will not transmit or make available any software or other computer files that contain a virus or other harmful components, or otherwise impair or damage the Platform or any connected network, or otherwise damage, disable, overburden, impair, or compromise the Platform, our systems or security, or interfere with any person or entity's use or enjoyment of the Platform.
You will not post, publish, or transmit any content or messages that:

Are false, misleading, defamatory, harmful, threatening, abusive, or constitute harassment;
Promote racism, hate slurs, or violent behavior, or support hate groups, terrorism, self-harm, suicide, or harm against any individual, group, religion, or caste;
Infringe another's intellectual property rights, violate laws or regulations, or encourage illegal conduct;
Depict or encourage profanity, nudity, inappropriate clothing, sexual acts, sexually suggestive poses, or degrade or objectify people.

You will not promote the use of explosives, firearms, psychotropic drugs, or any other illegal activities.
You will not disparage, make false, or malicious statements against us or in connection with the Services or the Platform.
You will not interfere or attempt to interfere with the proper working of the Platform or any activities conducted on the Platform.
You will not bypass any measures we may use to prevent or restrict access to the Services.
You will not run any form of autoresponder or “spam” on the Platform.
You will not use manual or automated software, devices, or other processes to “crawl” or “spider” any part of the Services.
You will not modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, republish, repurpose, sell, trade, or exploit the Service in any way, except as expressly authorized by us.
You will not delete or modify any content of the Services, including but not limited to legal notices, disclaimers, or proprietary notices such as copyright or trademark symbols, logos, unless you have express permission to do so.

You are responsible for all activities that occur on or through your account. To protect your account, keep your password confidential. Do not reuse your account password with other services. Without prejudice to your statutory rights, if you forget your password and otherwise cannot validate your account to the Platform, you acknowledge and agree that your account may be inaccessible to you and that all data associated with the account may not be retrievable.

Payment Terms

You hereby acknowledge and agree that in order to avail our pujas, astrology, Special Darshan services, and/or any other service provided, you explicitly agree to pay the fees in a manner and mode as notified to you by us. The said fee is subject to a periodic review and may be revised at our sole discretion, and such revisions may be intimated to you as and when required. Please note that your network operator may also separately charge you for data and other usage.

Cancellation And Refund Policy

Cancellation For Astrology Services

You may request to cancel your astrology service (live or recorded) up to 24 (twenty-four) hours before the scheduled time of the session. For cancellation, you may contact us by calling +91 8874990298 or sending an email to support@ayodhyatra.live. A full refund will be provided to your original payment source within 7-10 (seven to ten) business days. Cancellations made less than 24 hours before the scheduled session will not be eligible for a refund.

Refund Eligibility For Live Astrology Service

Refunds may be considered in the following instances only:

Network issues affecting the meet during the service, including weak signals, background noise, or inaudibility of the astrologer during the session.
The astrologer was unable to respond fluently in the language provided in their profile.
The astrologer took an inordinately long time to respond to the user’s inquiry or request for guidance.
The astrologer provided irrelevant or inappropriate responses to the user's questions or concerns.

Refunds Not Applicable For Live Astrology Service

No refund shall be processed in the following instances (except as provided under Section 8.2):

The order has reached the processing stage, i.e., an astrologer has already been assigned, and the Zoom or Google Meet link for the session has been shared/sent to the user.
The Platform suffers a technical delay or glitch in processing the request or generating the astrology report.
The information provided by you is incorrect. You agree to verify any information submitted to the Platform and ensure that such information is accurate. In the event the information provided by the user is incorrect, you may request to rectify it, provided the request is made within 1 (one) hour from the conclusion of the service(s) rendered by the astrologer.
The contact details provided by you for the astrology service are incorrect, including the email address or phone number used to receive the Zoom/Google Meet link. You are required to ensure that the details provided are valid and accessible for the session.
Inaccurate results from the consultation. Please note that we do not take responsibility for the factual accuracy of the results arising from the service rendered.

Refund Eligibility For Recorded Astrology Service

Refunds may be considered in the following instances only:

Network issues affecting the recording: If there were technical difficulties (e.g., poor audio or video quality, connectivity issues) that impacted the clarity or completeness of the recorded reading.
Incorrect or incomplete astrology report: If the astrologer provided inaccurate or incomplete information that significantly impacted the value or relevance of the reading.

Refunds Not Applicable For Recorded Astrology Service

No refund shall be processed in the following instances:

The reading has already been completed and the video has been delivered to the user.
The information you provided is incorrect: If incorrect details were provided, such as (but not limited to) incorrect birth details or contact information, refunds will not be issued.
Personal dissatisfaction with the astrology reading: Refunds will not be issued for personal opinions, preferences, or dissatisfaction with the insights provided in the recorded reading.
Technical issues unrelated to our service: If the issue arises due to the user’s device or internet connection, no refund will be processed.

Refund Eligibility For Pujas

Refunds may be considered only in the following instances only:

Technical issues during the video that significantly affect your ability to watch or experience the Puja, such as video or audio failure.
Incorrect content or disruption that causes significant deviation from the planned Puja service.
Failure to receive the recorded video due to technical issues or delay from our side.

Refunds Not Applicable For Pujas

No refund shall be processed under the following circumstances:

The Puja has already been completed, and the recorded video has been delivered.
The information you provided is incorrect, including an incorrect email address or contact details.
The recorded video is available, but you were unable to view it due to technical issues on your end, such as device compatibility or connectivity issues.
Inaccurate expectations or results from the Puja—refunds will not be issued based on personal interpretations or outcomes of the Puja.

Refund Eligibility For Special Tour and Darshan Service

Refunds may be considered only in the following instances only:

Unavailability of the scheduled guide due to unforeseen circumstances on our part.
Failure to provide the agreed-upon tour experience (e.g., incorrect or incomplete tour services).

Refunds Not Applicable For Special Tour and Darshan Service

No refund shall be processed in the following circumstances:

The tour has already commenced or the guide has already met the user.
The information you provided is incorrect, such as wrong contact details or schedule details.
Personal reasons or dissatisfaction with the tour content—refunds will not be issued based on individual preferences or interpretations of the tour.
Cancellations made 72 hours or less prior to the scheduled tour. In this instance, no refund will be issued; however, credits will be provided which the user can redeem against any other service offered by us.

Refund Processing

We shall endeavor to address all requests for refunds, where eligible, within 24 hours of receipt of such requests for a refund. However, depending upon the jurisdiction of the transaction or your residence, the monies may reach your account anywhere between 7 – 28 working days. The refunds, if any, shall be processed after deduction of the transaction charges levied by the bank, the payment gateway, and/or any other charges that may have been incurred by the Platform during processing and/or delivering the service, as applicable.

Conditions To Use

Best Efforts Basis

The Services will be provided on a best-efforts basis. We will make reasonable efforts and shall endeavor to ensure that you are able to use the Services without undue disruption, interruption, or delay.

Commercial Communications

Once you log in to the Platform, you may receive updates, promotional materials, and other information we may send regarding the Service, or new services we may offer. You hereby consent to receiving all such commercial communications from us. You may opt out of receiving any, or all, of these commercial communications by simply de-selecting the option to receive such commercial communication at the time of creating the account or at any time thereafter by writing to us.

Disclaimers of Responsibility (Security)

We disclaim any responsibility for any harm resulting from anyone’s use of or access to the Services. If you avail of our Services, you are responsible for taking precautions as necessary to protect yourself and your devices from malware, viruses, spyware, trojan horses, worms, or trap doors, and other such harmful or destructive software. This Platform and the Services are provided on an “as is” and “as available” basis and you expressly agree that use of the same is at your sole risk. The Platform 1Play India or its affiliates do not make any representation or warranty of any kind, express or implied, or any guarantee or assurance that the Platform will be available for use, or that all Services, products, features, functions, or operations will be available or uninterrupted, timely, secure, or error free. We make no warranty as to the results that may be obtained from the use of the Services or the Platform, or as to the fitness, accuracy or reliability of any information obtained through the Services, or that the defects in the Services will be corrected. No advice or information, whether oral or through the Services or site shall create any warranty not expressly made herein.

To the extent permitted under any applicable law, will we, our officers, employees, directors, shareholders, affiliates, be liable for any direct, indirect, incidental, special, consequential, exemplary or reliance damages, including but not limited to damages for loss of revenues, profits, goodwill, use, data or other intangible losses, resulting from your (or anyone using your account) use of the Service or the portal.

Limitation of Liability

In those jurisdictions that do not permit exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages, our liability shall be the minimum permitted under such applicable law in such jurisdictions.

Intellectual Property

Ownership

You acknowledge and agree that Ayodhyatra, including all services, features, functionality, software, designs, text, sound recordings, and images on the Platform, copyrightable or otherwise legally protectable elements of the Platform, including, without limitation, the selection, arrangements, sequence and ‘look and feel’ and all trade marks, service marks and trade names; patents, designs, algorithms and other industrial property rights including the trademark AYODHYATRA and “logos”, all other trademarks, service marks, trade names, trade dress including all registrations, initial applications, renewals, extensions, continuations, divisions or reissues here now or hereinafter in force (including any rights in any of the foregoing) (individually and/or collectively or licensed to it, (“Intellectual Properties”), are and will remain the exclusive property of 1Play India or its licensors, successors and assigns, and any of their respective licensors, advertisers, suppliers and operational service providers and are legally protected, under India and foreign laws, regulations and treaties unless otherwise explicitly stated. You may access the Platform solely for your personal use of the Services offered.

Restrictions on Use

You may not copy, reproduce, modify, upload, post, transmit, distribute, or exploit any content, code, or material from the Platform or Services in any way without our prior written consent.

Third-Party Links

External Websites and Applications

The Platform may include links to third-party websites or applications. By accessing these links, you acknowledge and agree that:

These websites or applications are not controlled by 1Play India, and their terms of use and privacy policies may differ from ours.
The inclusion of a link does not imply any endorsement by 1Play India of the third-party website, application, its provider, or its content.
If you submit any personal information on these third-party platforms, it will be governed by their terms of use and privacy policies. 1Play India disclaims any responsibility or liability for their practices or content.

User Responsibility

We encourage you to review the terms of use and privacy policies of any third-party website or application you visit and exercise due and reasonable caution while disclosing your personally identifiable or sensitive personal information during your interaction with such third-party websites or service providers. 1Play India reserves the right to disable third-party links at any time but is under no obligation to do so.

Indemnity And Limitation Of Liability

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless 1Play India, its parent company (1Play India), officers, directors, employees, and agents from and against any losses, damages, costs, expenses, or claims arising out of:

Your use of the Platform or the Services;
Your breach of these Terms of Use or the Privacy Policy;
Any infringement of intellectual property or other rights belonging to 1Play India or third parties; or
Your violation of any applicable laws or regulations.

Limitation of Liability

To the fullest extent permitted by law, 1Play India, its parent company, affiliates, and employees shall not be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages arising out of:

Your use or inability to use the Platform or the Services;
Your reliance on any statements, advice, or content provided through the Platform or the Services; or
Any other matter related to the Platform or the Services, including but not limited to:

Data loss or corruption,
Loss of goodwill or business opportunities,
Technical errors, glitches, interruptions, or delays, or
Unauthorized access to your account or data. Any delay is accessing the Platform due to scheduled maintenance or network fluctuations

Internet Security Disclaimer

By using the Platform or the Services, you acknowledge and agree that internet transmissions are never completely private or secure. While 1Play India employs reasonable security safeguards to prevent personal data breach through - encryption, obfuscation or masking or the use of virtual tokens mapped to that personal data; visibility on the accessing of such personal data, through appropriate logs, monitoring and review, for enabling detection of unauthorized access, its investigation and remediation to prevent recurrence; appropriate technical and organizational measures to ensure effective observance of security safeguards, and other such safeguards. Any message or information sent via the Platform may be read or intercepted by unauthorized parties. You expressly assume this risk when transmitting information.

Termination

Termination by Us

We may terminate or suspend your access to the Platform or any part of the Services at any time, with or without cause, and with or without prior notice, effective immediately. Any suspected illegal, fraudulent, or abusive activity will also be grounds for terminating your access to the Platform and/or the Services provided thereunder. In such an eventuality, you agree and consent that unless we are required to store your information in law, for the purposes of legal investigation and/or fraud detection and/or any other wrong-doing, will be deleted, with no further recourse.

Cease of Operations

We reserve the right to:

Discontinue the operation of the Platform or any Services at any time without notice.
Terminate these Terms of Use at our sole discretion.

Information Storage, Update or Deletion

All Users, hereby consent to the Platform and its third party service vendors storing and managing personal information of the Users for the purposes and duration for which the User provided consent and provided information during the setting up on an account on the Platform, including on behalf of the minors, subject to it being uploaded on the Platform by the parent or the legal guardian. All Users may modify, update or otherwise change the information provided, including on behalf of the minors, subject to it being modified, updated or otherwise changed on the Platform by the parent or the legal guardian of such minor, or delete it altogether and hereby provide consent to such deletion, upon termination of their account or completion of the Services, unless required by law, for a period required by law.

Upon termination, deletion of the account or cessation of operations by the Platform, you agree and consent that unless we are required to store your information in law, for the purposes of legal investigation and/or fraud detection and/or any other wrong doing, will be deleted with no further recourse.

Survival of Terms

Upon termination, all provisions of these Terms of Use that are intended to survive termination shall remain in effect, including but not limited to provisions related to intellectual property (Clause 10), indemnity and limitation of liability (Clause 12), storage of information for lawful purpose (Clause 13.1, 13.3) and disclaimer (Clause 14).

Disclaimer

Scope of Services

The Services provided on the Platform are focused on Sanatana Dharma. You acknowledge that this focus is not intended to discriminate against or disrespect other religions or practices. It is not a preference of one religion over another.

No Warranties on Effects or Outcomes

We do not warrant or guarantee the accuracy, reliability, or effectiveness of astrological and/or other services offered on the Platform. Any advice or information, whether oral or written, obtained through the Platform does not constitute a warranty by 1Play India or its parent company, 1Play Global, Singapore.

We do not endorse or promote practices such as black magic, witchcraft, voodoo, or tantrism. Additionally, the Platform is not a substitute for professional medical advice, and users experiencing health issues are advised to seek appropriate medical care.

Third-Party Service Providers

Advisors, pandits, astrologers, guides, and consultants available on the Platform are third-party service providers and not employees of Platform or 1Play India. You interact with them at your own risk, and we assume no responsibility or liability for their actions, advice, or content.

We explicitly prohibit the sharing of any personally identifiable information, sensitive personal information as well as personally identifiable information of the minors with the advisors, astrologers, guides, and consultants available on the Platform, especially contact, bank, payment gateway or Aadhar and such other Government issued identity card or the details thereof. The Company will not be responsible for any contact made outside the Platform and/or without the express written consent or confirmation of the Company.

We do not verify, endorse, or guarantee the quality, accuracy, or validity of any third-party advice or services. Furthermore, we disclaim any liability for disputes between you and these providers. We may discontinue any third-party service at any time without notice or liability.

No Special Relationship

We do not have any fiduciary duty or special relationship with the users. The Platform and/or 1Play India will not be responsible for any potential effect of the Services(s) rendered to the users and will be under no obligation to act on behalf of the users regarding any such effect.

Services Provided "As Is"

The Services are provided "as is" without warranties of any kind. We do not guarantee the accuracy, adequacy, or suitability of the Services for any purpose and accept no liability for your reliance on any claims or statements made through the Platform.

Jurisdictional Use

We make no representation that the content on the Platform is appropriate for use outside India. Users accessing the Platform from other jurisdictions do so at their own risk and are responsible for compliance with local laws and these Terms of Use.

Governing Law

Admissibility in Proceedings

A printed version of these Terms of Use and any electronically delivered notice shall be admissible in judicial or administrative proceedings related to these Terms of Use, to the same extent as other business documents and records originally created and maintained in printed form.

Applicable Law and Jurisdiction

These Terms of Use are governed by and interpreted in accordance with the laws of India. You consent to the exclusive jurisdiction of the courts having jurisdiction and located in Bangalore, Karnataka, India, for all disputes arising from or related to these Terms of Use, Privacy Policy or the use of the Services.

Use of the Platform is not permitted in any jurisdiction where these Terms of Use, including this clause, are not enforceable.

Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, it shall be limited or removed to the extent necessary, and the remaining provisions shall remain fully enforceable and effective.

Failure by either party to enforce any provision or exercise any rights under these Terms of Use does not constitute a waiver of those rights. Any waiver of compliance must be provided in writing and authorized by us to be valid. Waiving compliance in one instance does not mean future compliance will also be waived.

Modification Of Terms Of Use

We reserve the right, at our sole discretion, to modify or replace any of these Terms of Use, or change, suspend, or discontinue any part of the Services (including, without limitation, any feature, database, or content) or its usage, at any time. Such changes may be communicated by posting a notice on the Platform or by sending you a notice via the Service or email/contact details provided during registration.
